These Terms of Service (“Terms”) govern your use of the MemoryLocket website and the purchase of any products or services from MemoryLocket (“we”, “us”, “our”).
By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. About MemoryLocket
MemoryLocket creates personalised jewellery products that may include custom engraving, digital media storage, and NFC-enabled features.
Our products are custom-made based on the information and media you provide.
2. Eligibility
By using our website, you confirm that:
- You are at least 18 years old, or have permission from a parent or legal guardian
- You are legally capable of entering into a binding contract
3. Orders & Custom Products
a) Customisation
All MemoryLocket products are made to order using the photos, videos, text, or other content you submit.
You are responsible for ensuring that:
- Uploaded content is accurate
- Names, dates, and spellings are correct
- Media belongs to you or you have permission to use it
Once production has started, custom details cannot be changed.
b) Order Acceptance
We reserve the right to refuse or cancel any order at our discretion, including for:
- Suspected fraud
- Inappropriate or unlawful content
- Technical errors or pricing mistakes
If your order is cancelled, you will be refunded in full.
4. Pricing & Payments
- All prices are shown in the currency displayed at checkout
- Prices may change at any time without notice
- Payment is required in full before production begins
Payments are processed securely through third-party providers. We do not store your full payment details.
5. Production & Delivery
a) Production Time
MemoryLocket products are handcrafted and customised. Production times are estimates and may vary during busy periods.
b) Shipping
Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by:
- Postal or courier services
- Customs clearance
- Incorrect shipping details provided by the customer
6. Digital Content & MemoryLink™ Technology
Some MemoryLocket products include digital features such as Memory Linked media pages.
- You are responsible for the content you upload
- We do not guarantee uninterrupted access to digital features
- We may update, improve, or modify digital services over time
We reserve the right to remove content that violates these Terms or applicable laws.
7. Returns, Refunds & Cancellations
a) Custom Products
Due to the personalised nature of MemoryLocket products, custom orders are non-refundable and non-returnable, except where required by law or in cases of defect.
b) Faulty or Damaged Items
If your item arrives damaged or faulty, you must contact us within 7 days of delivery with photo evidence.
If approved, we may offer:
- A replacement
- A repair
- A refund (at our discretion)
8. Intellectual Property
All content on the MemoryLocket website, including text, images, designs, branding, and software, is owned by or licensed to MemoryLocket.
You may not copy, reproduce, distribute, or use our content without written permission.
9. User Content
By uploading photos, videos, or text, you:
- Retain ownership of your content
- Grant MemoryLocket a limited licence to use it solely to produce your order and provide related services
We will never sell or publicly display your content without consent.
10. Prohibited Use
You agree not to:
- Upload unlawful, abusive, or infringing content
- Attempt to misuse or interfere with our systems
- Use our website for fraudulent or harmful purposes
We may suspend or terminate access if these Terms are violated.
11. Limitation of Liability
To the fullest extent permitted by law:
- MemoryLocket is not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for your order
Nothing in these Terms limits your statutory consumer rights.
12. Warranties & Disclaimers
MemoryLocket products are provided “as is” and “as available”.
We do not guarantee that:
- The website will always be error-free or uninterrupted
- Digital features will be permanently available
13. Force Majeure
We are not responsible for delays or failures caused by events beyond our control, including but not limited to natural disasters, strikes, supplier delays, or technical outages.
14. Governing Law
These Terms are governed by and interpreted in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Mobile Messaging Terms of Service (SMS)

The MemoryLocket mobile messaging service (the “Service”) is operated by MemoryLocket (“MemoryLocket”, “we”, “us”, or “our”).
By opting in to receive SMS/text messages from MemoryLocket, you agree to these Mobile Messaging Terms and Conditions (“Mobile Terms”). Your participation in the Service constitutes your acceptance of these Mobile Terms.
We may modify or discontinue the Service, or any of its features, at any time without notice. To the extent permitted by applicable law, we may also update these Mobile Terms from time to time. Continued participation in the Service after any changes take effect constitutes acceptance of those changes.
Consent to Receive Messages
By providing your mobile number and opting in, you consent to receive recurring SMS/text messages from and on behalf of MemoryLocket, sent through your wireless provider to the mobile number you provided — even if your number is registered on a state or federal Do Not Call list.
Messages may be sent using automated technology.
Message types may include:
- Order updates and delivery notifications
- Account or service-related messages
- Cart reminders
- Occasional promotional messages, offers, or announcements
Consent to receive SMS messages is not a condition of purchase. Participation in the Service is completely voluntary.
Costs & Message Frequency

Opting Out
You may opt out of the Service at any time by replying STOP to any MemoryLocket message.

If you are subscribed to multiple MemoryLocket messaging programs, you must opt out of each program separately unless otherwise required by law.

Carrier Disclaimer
Wireless carriers are not responsible for delayed or undelivered messages.

You are responsible for providing a valid mobile number. If your number changes, you must re-enroll using your new number.
Limitation of Liability
To the fullest extent permitted by law, MemoryLocket shall not be liable for:
- Failed, delayed, or misdirected message delivery
- Errors in SMS content
- Any actions taken or not taken based on messages sent through the Service
